BITE LIKE A MAN™
COMMUNITY PARTICIPATION AGREEMENT, DISCLAIMER, ASSUMPTION OF RISK, RELEASE OF LIABILITY & SURVIVAL OF TERMS
PLEASE READ CAREFULLY. THIS IS A LEGALLY BINDING AGREEMENT.
By checking the box below, enrolling, purchasing, accessing, or participating in any Bite Like a Man™ community offerings, including but not limited to Zoom meetings, group discussions, online forums, written materials, audio/video content, or any related resources (collectively, the “Community”), you (“Participant,” “Member,” “you”) acknowledge that you have read, understood, and voluntarily agree to all terms set forth in this Agreement.
1. NO MEDICAL, MENTAL HEALTH, OR THERAPEUTIC SERVICES
I understand and acknowledge that:
• Bite Like a Man™ is not a medical, mental health, psychological, psychiatric, or therapeutic service.
• Danny O’Connor, Bite Like a Man™, and any moderators, facilitators, guests, or participants are not acting as therapists, psychologists, psychiatrists, dietitians, physicians, or licensed healthcare providers.
• No diagnosis, treatment, therapy, counseling, medical advice, or clinical services are provided.
• Participation does not create a therapist–patient, counselor–client, doctor–patient, fiduciary, or clinical relationship of any kind.
All content and discussion are educational, peer-based, and experiential only, based on lived experience and community dialogue.
2. NOT A SUBSTITUTE FOR PROFESSIONAL CARE
I understand and agree that:
• The Community is not a substitute for professional medical care, mental health treatment, nutritional counseling, or emergency services.
• I am solely responsible for seeking qualified professional help for any physical, mental, medical, psychiatric, eating disorder, or health-related concerns.
• Bite Like a Man™ does not provide crisis intervention or emergency support.
If I am experiencing severe distress, suicidal ideation, thoughts of self-harm, or a medical or psychiatric emergency, I will immediately contact emergency services (911 in the U.S.) or a qualified crisis resource, such as the Suicide & Crisis Lifeline (call or text 988 in the U.S.).
3. VOLUNTARY PARTICIPATION & ASSUMPTION OF RISK
I acknowledge that:
• Participation may involve discussion of sensitive topics, including eating disorders, trauma, shame, recovery, addiction, and mental health.
• Such discussions may be emotionally challenging or triggering.
• I voluntarily choose to participate and accept full responsibility for my emotional, psychological, and physical well-being.
I knowingly and voluntarily assume all risks, known and unknown, arising from my participation, including emotional distress, discomfort, relapse, or worsening symptoms.
4. PERSONAL RESPONSIBILITY & DECISION-MAKING
I agree that
• I am solely responsible for my decisions, actions, behaviors, and outcomes.
• I will use my own judgment and discretion regarding anything discussed.
• Bite Like a Man™ makes no guarantees regarding recovery, improvement, outcomes, or results of any kind.
5. NO RELIANCE ON STATEMENTS OR SHARED EXPERIENCES
I acknowledge that:
• Statements made by Danny O’Connor or other participants reflect personal opinions and lived experiences, not professional advice.
• I will not rely on any information shared as medical, psychological, nutritional, or therapeutic guidance.
• What works for one individual may not be appropriate for another.
6. CONFIDENTIALITY & COMMUNITY LIMITATIONS
While Bite Like a Man™ encourages respectful and confidential dialogue:
• Confidentiality cannot be guaranteed in group or online settings.
• I agree not to record, screenshot, share, or distribute community discussions without permission.
• Bite Like a Man™ is not responsible for the actions or disclosures of other participants. I understand that I am responsible for my own privacy choices.
7. RELEASE OF LIABILITY (VERY IMPORTANT)
To the fullest extent permitted by law, I hereby release, waive, discharge, and hold harmless Danny O’Connor, Bite Like a Man™, its owners, operators, affiliates, employees, contractors, moderators, volunteers, and representatives from any and all claims, demands, damages, losses, liabilities, costs, or expenses, whether known or unknown, arising out of or related to:
• My participation in the Community
• Any emotional or psychological responses
• Any decisions I make based on Community content or discussions
• Any interactions with other participants
• Any alleged negligence or omission
This release applies to all claims, including but not limited to emotional distress, mental anguish, personal injury, economic loss, or any other damages, to the maximum extent permitted by law.
8. NO WARRANTIES
The Community is provided “AS IS” and “AS AVAILABLE,” without warranties of any kind, express or implied. Bite Like a Man™ disclaims all warranties, including but not limited to accuracy, completeness, merchantability, fitness for a particular purpose, or non-infringement.
9. INDEMNIFICATION
I agree to indemnify and hold harmless Danny O’Connor and Bite Like a Man™ from any claims, damages, losses, liabilities, or expenses (including reasonable attorneys’ fees) arising from my participation, conduct, or violation of this Agreement.
10. GOVERNING LAW & VENUE
This Agreement shall be governed by and construed in accordance with the laws of the State of Colorado, without regard to conflict-of-law principles. Any disputes not otherwise barred shall be resolved exclusively in the state or federal courts located in Colorado.
11. SURVIVAL OF AGREEMENT
All provisions of this Agreement which by their nature should survive termination or expiration shall survive, including but not limited to:
• No Medical or Therapeutic Services Disclaimer
• Not a Substitute for Professional Care
• Assumption of Risk
• Release of Liability
• Indemnification
• Confidentiality
• No Warranties
• Governing Law and Venue
Termination of participation, cancellation, expiration, or loss of access to the Community shall not affect the enforceability of these provisions.
12. SEVERABILITY
If any provision of this Agreement is found to be unenforceable, the remaining provisions shall remain in full force and effect.
13. ACKNOWLEDGMENT & ACCEPTANCE
By checking the box below, I confirm that:
• I am at least 18 years old
• I have read and fully understand this Agreement
• I voluntarily agree to all terms
• I understand participation is at my own risk
• I knowingly release Bite Like a Man™ from liability as stated above
